Hillary Richard’s practice focuses on commercial litigation, securities law, regulatory and administrative proceedings and trial practice. From 1988 through 1994, Ms. Richard was an associate at Rabinowitz, Boudin, Standard, Krinsky & Lieberman, P.C. She was a partner with that firm from 1994 through 1998. In 1998, Ms. Richard received the 1998 Women of Power and Influence Award from the National Organization for Women, New York City. Ms. Richard has litigated numerous civil and criminal cases in New York, California, Washington, Louisiana, Florida, Michigan, Massachusetts, North Carolina, Pennsylvania and the District of Columbia. She has tried cases in state, federal and military courts. She represents a number of financial institutions, including hedge funds, private equity funds, commercial banks, investment firms and broker-dealers in federal securities fraud, breach of contract, breach of fiduciary duty, trade secret and successor liability actions. She has successfully moved to dismiss claims made against her clients, most recently winning the dismissal of a $200 million securities fraud case. She obtained a judgment in excess of $1.3 million against a defaulting issuer and previously obtained a multimillion dollar contempt fine against a borrower that had defaulted on its obligations. Ms. Richard successfully defended an investment bank in a $55 million fraud claim and a hedge fund in a multi-million dollar breach of contract action.

In addition, Ms. Richard has represented individuals and institutions in regulatory and administrative proceedings. Ms. Richard has also represented defendants in a multi-count RICO criminal case, which involved the seizure of millions of dollars and numerous properties based on allegations of fraud and money laundering. Ms. Richard challenged the forfeiture, the seizure of documents and the sufficiency of the money laundering allegations. She successfully moved for the dismissal of a subsequent civil RICO case brought against the same defendants. In so doing, she developed an expertise in criminal and civil RICO and forfeiture statutes, and has subsequently represented others charged with similar violations.

Ms. Richard regularly teaches trial techniques at the Benjamin N. Cardozo School of Law’s Intensive Trial Advocacy Program and has lectured at the Practicing Law Institute. In addition, she has lectured widely on issues pertaining to civil and criminal law and has provided legal commentary on television on a variety of legal issues.

Ms. Richard graduated from Harvard Law School in 1988 with honors. She received the C. Clyde Ferguson Fellowship in Human Rights in 1986. She graduated from Fordham University, College at Lincoln Center, summa cum laude in 1985.
