David Elbaum is an experienced litigator who handles both civil and white collar matters. He represents individuals, corporations and investment firms in federal and state courts around the country, in private arbitrations and in regulatory investigations. He has handled a wide range of complex cases, including securities fraud, corporate governance and fiduciary duty, antitrust, insurance and breach of contract.

Representative matters
- Obtaining the dismissal of a securities fraud claim against the manager of a collateralized debt obligation (CDO) fund;
- Representing the special litigation committee of the board of directors of a major defense contractor and obtaining the dismissal of a derivative action against the directors;
- Defending an investment fund manager in a $100 million breach of contract action;
- Successfully defending an investment bank in a $55 million fraud claim;
- Defending an investment fund and its manager in a multi-million dollar dispute arising from complex leasing arrangements entered into by a portfolio company; and
- Successfully representing a manufacturing company in a Department of Labor investigation relating to its benefit plans.
